By accessing or using our website, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must not access or use the website.
2. About Shyam Gifts
Shyam Gifts is an online gift store based in Purulia, West Bengal, India. We offer a curated selection of gifts for various occasions including birthdays, anniversaries, festivals, and more.
Our physical store is located at: Shyam Gifts, Near Apna Ghar Ashram, GariKhana, Purulia - 723101, West Bengal.
Business Details: Shyam Gifts is not registered under GST. All prices on the website are in Indian Rupees (INR). Prices may be subject to change without prior notice.
3. Eligibility
You must be at least 18 years old to place an order on our website. By placing an order, you represent that you are at least 18 years old and have the legal capacity to enter into a binding contract.
If you are under 18, you may use our website only with the involvement and consent of a parent or legal guardian.
4. Orders and Payments
4.1 Order Placement
When you place an order through our website, you are making an offer to purchase the selected products. We reserve the right to accept or decline your order at our discretion.
4.2 Pricing
All prices displayed on our website are in Indian Rupees (INR) and are subject to change without prior notice. Prices displayed at the time of checkout are the prices you will be charged.
4.3 Payment Methods
We accept online payments through our secure payment gateway powered by Razorpay for all locations across India. Accepted methods include UPI, credit cards, debit cards, net banking, and wallets.
Cash on Delivery (COD) is available only for deliveries within Purulia (723101). A nominal COD convenience fee may apply at checkout. COD is not available for personalized or custom-made products. All payment information is processed securely and we do not store your payment card details.
4.4 Order Confirmation & Notifications
After placing an order, you will receive an order confirmation via email (sent through Resend) or WhatsApp. You may also receive delivery updates and shipping notifications via email or WhatsApp. This confirmation does not constitute acceptance of your order. Your order is accepted only when the products are dispatched.
4.5 Order Cancellation
You may cancel your order before it has been dispatched by contacting us via phone, WhatsApp, or email. Once the order has been dispatched, it cannot be cancelled and our Returns & Refunds Policy will apply.
For personalized or custom-made products, cancellations are only accepted within 2 hours of order placement, provided production has not yet begun.
5. Shipping and Delivery
We deliver within Purulia (723101) and to other cities across India. We do not ship internationally. Delivery timelines and shipping charges vary based on your location. Please refer to our Shipping Policy for detailed information.
Same-day delivery is available in Purulia for orders placed before 2:00 PM on business days. For other cities, delivery typically takes 5-7 business days via our courier partner.
We make every effort to deliver within the estimated timelines, but delays may occur due to factors beyond our control including weather, traffic, courier partner delays, or force majeure events.
Risk of loss and title for products pass to you upon delivery to the address provided by you.
6. Returns and Refunds
6.1 No Returns Accepted
We do not accept any returns once an order has been delivered. All sales are final. Please review your order carefully before placing it.
6.2 Damaged or Defective Products
If you receive a product that is damaged, defective, or not as described, please contact us within 2 days of delivery. You may raise a support ticket for your order from the Orders page, or contact us via WhatsApp, phone, or email with clear photos of the product and packaging. We will verify the details and initiate the required steps from our end, which may include a replacement or refund at our sole discretion.
6.3 Wrong Product Delivered
If you receive a product different from what was ordered, please contact us within 2 days of delivery via WhatsApp, phone, email, or by raising a support ticket for your order. Include photos of the received product and packaging. We will verify the mismatch and, if confirmed, arrange for the correct product to be delivered or issue a refund at our discretion.
6.4 Non-Returnable Items
Personalized or custom-made products and perishable items cannot be returned. However, if they are damaged or defective, you may still report the issue within 2 days of delivery as described above.
6.5 Refund Processing
Approved refunds are initiated manually after our internal verification and may take 5-7 business days to reflect in the original payment method. For any refund-related queries, please contact us directly.
7. User Accounts
To place an order, you may need to create an account. You are responsible for:
- Maintaining the confidentiality of your account credentials
- All activities that occur under your account
- Providing accurate and up-to-date information
We reserve the right to suspend or terminate accounts that are used inappropriately or in violation of these Terms.
8. Intellectual Property
All content on this website, including but not limited to text, images, graphics, logos, icons, and software, is the property of Shyam Gifts or its content suppliers and is protected by applicable intellectual property laws.
You may not reproduce, distribute, modify, create derivative works from, publicly display, or exploit any content from this website without our prior written consent.
9. Prohibited Uses
You agree not to use our website to:
- Violate any applicable law or regulation
- Place fraudulent or unauthorized orders
- Interfere with or disrupt the website or servers
- Use automated tools to scrape or access the website
- Transmit any harmful or malicious code
- Impersonate another person or entity
10. Limitation of Liability
To the maximum extent permitted by law, Shyam Gifts shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of the website or any products purchased through it.
Our total liability for any claim arising out of or relating to these Terms or our products shall not exceed the amount you paid for the specific product giving rise to the claim.
11. Dispute Resolution
Any disputes arising out of or relating to these Terms or your use of the website shall first be attempted to be resolved through amicable negotiation.
If the dispute cannot be resolved through negotiation, it shall be subject to the exclusive jurisdiction of the courts in Purulia, West Bengal, India.
These Terms shall be governed by and construed in accordance with the laws of India.
12. Force Majeure
We shall not be held liable for any failure or delay in performing our obligations under these Terms where such failure or delay results from causes beyond our reasonable control, including but not limited to natural disasters, war, acts of terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, strikes, pandemics, shortages of transportation facilities, fuel, energy, labor, or materials, or failures of telecommunications or internet service providers.
13. Grievance Officer
In accordance with the Information Technology Act, 2000, the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, and the Consumer Protection (E-Commerce) Rules, 2020, the name and contact details of the Grievance Officer are provided below:

The Grievance Officer shall acknowledge receipt of any consumer complaint within 48 hours and redress the complaint within 30 days from the date of receipt.
